Case Summary:

Ms.Pooja Dodd is appointed as the arbitrator by NIXI on 5th January with the copy of the complaint, on 7th January she got a call from Respondent to discuss about the complaint. Arbitrator has advised the respondent all the communication only by e-mail in the presence of NIXI.

On 16th January, Legal Officer of NIXI informed to the arbitrator “Respondent has refused to accept the courier”.At the same time arbitrator replied that “I got a call from the Respondent regarding complaint”.

On 18th January, Respondent sent an e-mail to arbitrator and complainant with the presence of NIXI “Ready to release the domain without proceedings”.

As per the NIXI rule, to win the domain from the respondent in an INDRP dispute, The complainant must prove all three following grounds.

1.Registrant’s domain name is identical or confusingly similar to a name, trademark or service mark in which Complainant has rights.

2.The registrant has no rights or legitimate interests in respect of domain name.

3.Registrant’s domain has been registered or being used in bad faith.

In this particular dispute, respondent has agreed to release the domain name on his own will, so the arbitrator has straight away awarded the domain name in favour of complainant.
